Personal Injury Checklist

    False arrest, detention or imprisonment
      Interview the insured about what happened
    where the incident occurred
    how the incident happened
    who were involved and who were witnesses
    and the reasons for the incident 
     
      What if any medical or other treatment was
    received by the claimant after the incident. 
     
      Obtain any documents that relate to the incident.   
      If the insured is an organization,
    was anyone in authority aware of the incident
    and was any action taken. 
     
      If an employee of the insured was involved
    review personnel records. 
     
    Malicious prosecution. 
      Interview the insured on the circumstance underlying
    the legal action. 
     
      Interview the insured's legal counsel regarding
    the merits of the case. 
     
      Determine the costs incurred by the claimant
    in defending the legal action. 
     
      Obtain from the claimant the facts supporting
    their various damage claims.  
     
    Wrongful eviction. 
      Interview the insured about what happened
    how the incident happened
    location of the occupancy
    the nature of the occupancy
    and the reasons for the invasive activities.  
     
      Obtain expert opinion on legal grounds
    for the invasive activities.  
     
     
    Determine the claimed damages and
    and the evidence supporting damages.  
     
    Defamation. 
      Obtain insured's rendition of any oral publication
    or copy of any written publication. 
     
      Obtain from the insured the purpose of the publication
    and its context.  
     
      Determine the extent of the publication.    
      Obtain from the insured facts underlying
    the material published.
    Do facts support the truth of
    the publication?  
     
      Identify and interview witnesses to oral publications.   
      Determine what damages are claimed
    and obtain evidence supporting
    those damages.
